4、在机械施工中，乙方应自行了解熟悉工作环境，由操作失误所造成的一切后果均由乙方负责(如地下管线、空中线路等)。
5、乙方提供与租赁费用等额的税票，满足甲方单位财务制度要求。
6、乙方负责机械进出场费用。
7、乙方负责其机械操作人员安全生产文明施工教育。
8、乙方配合甲方搞好工作计量工作。
9、乙方负责机械保养，配备足够机械操作人员，满足工地24小时连续施工的要求。

一、设备的使用地点：旺苍县三江镇华山村

六、甲方的基本责任

3、甲方承诺出租给乙方的设备属自己所有，合法有效，无他人主张权力，甲方承担购买设备相关的按揭费。
七、乙方的基本职责
1、设备维护保养由甲方负责，乙方提供使用油料必须是中石油柴油，甲方挖机驾驶员验收油票。
2、乙方租用期间造成甲方设备损坏不可复原或丢失，乙方按购机的年限折旧价额赔偿。
3、乙方租用甲方设备的期间内出现事故等责任由乙方全部承担，甲方不负任何连带责任。
4、乙方负责挖机驾驶员食宿。
5、设备运行正常使用老化而至无法恢复的，乙方不承担任何责任。
6、乙方必须购买建安险。
八、设备租赁期间乙方如需转移工地施工，必须征得甲方书面同意，擅自转移按违约处理。
九、租赁期满后，如乙方要求继续租赁，同等条件下乙方有优先租赁权。如不再租赁，乙方退还给甲方的设备确保正常运行。
十、违约赔偿：租赁期间任何一方提出终止合同，需书面通知对方，经双方协商后签订《终止合同书》，若一方强行中止合同，须向另一方支付每台违约金18000.00元(大写：壹万捌仟元整)。(注：违约金只能作为违约赔偿金不抵扣其它款项)。
十一、争议的解决
有关本合同的一切争议，甲乙双方应根据《中华人民共和国合同法》及其他相关法律的有关条款友好协商解决，如协商不成，提交合同履行地即旺苍县法院起诉。

6.付款：Payment:
承租人付给出租人的全部租金分两次支付，每一次于货到目的港日算起6个月后支付；第二次于货到目的港日算起12个月后支付。全部租金以美元支付，电汇出租人××银行或出租人临时指定的银行。交货后，无论承租人是否使用了商品，包括因不可抗力事故，均须按上述条件向出租人支付租金。

Right of Using the Commodity:
除了承租人以外，任何人不经出租人书面同意，不得使用该商品。
Nobody except the Leasee may use the commodity, but the Leasee shall not allow any other person to use the commodity without the Leasor's prior written consent.
12.保证： Guarantee:
承租人在签约后，但必须在装运期一个月前，向出租人提交 中国银行出具的以出租人为受益人的保证函，作为承租人履行本协议全部义务的保证金。
The Leasee shall furnish the Leasor, on/after the signing of this agreement but not later than one month prior to the date of the shipment of the commodity stated herein, with a letter of guarantee issued by Bank of China, ______in favour of the Leasor as the secruity of full execution of the Leasee's obligations under this agreement.
13.延期付款的罚金：Default Interest:
若承租人未按期付款，则必须向出租人交纳延期款项的罚金，年率为×%，时间从付款到期日计算至实际付款日期。
In case the Leasee is in default of any payment herein,the Leasee shall pay the Leasor a default interest on the amount delayed at the rate of ____% per annum as from the date when the payment is due to the date of actual payment.
14.维修：Maintenance:
承租人必须自负费用维持商品的良好状况；但是出租人必须对商品的故障负责，承租人有权想出租人提出赔偿因此所遭受的损失。
